Delhi HC pulls up BAI for not furnishing information

HYDERABAD: The Badminton Association of India (BAI) has drawn flak from the court for refusing to give some basic information it had asked for. The Delhi High Court, in its order dated December 24, 2014, had questioned how BAI, a National Sports Federation (NSF), accepts members without verifying their charter documents.

The court also said: "This would be an appropriate case where Government of India should examine the manner in which the National Sports Federation is functioning."

It all started when the suspended Delhi Badminton Association (DBA) asked BAI to provide the rules and regulations of each of its affiliated units under the Right to Information Act, 2005. When BAI refused to do so, DBA approached the Chief Information Commissioner (CIC), who directed the national body on December 8, 2014 to furnish a copy of rules and regulations of each affiliated unit.

BAI then approached the court to get a stay on the order of the CIC. While dismissing BAI's application, the court observed: "This implies that the petitioner has accepted member associations without being aware of their respective charters, rules and regulations. The petitioner is a National Sports Federation and it, prima facie, appears that it would be grossly improper if a NSF accepts members without verifying their charter documents."

The honorable judge also said that the information sought by the respondent should in any event be available in the public domain. What is baffling is that BAI has used the services of five lawyers to fight this case to avoid giving information which should have been on its website.

Ever since the new body took over after the Delhi Commonwealth Games, BAI has been embroiled in several cases. BAI president Akhilesh Das Gupta, a former Rajya Sabha member, is being accused of arbitrary rule. A Public Interest Litigation (PIL) recently was filed on how the current BAI officials are trying to change the association's constitution in a bid to retain control over the national body.
